1. Scope of Services

ClaimKite provides fixed-scope regulatory compliance audits and products of product labeling, packaging, advertising copy, and digital product listings for consumer packaged goods (CPG) brands in the food, beverage, supplement, and wellness industries. Services are rendered based on materials provided by the client and are limited to those specific submissions.

ClaimKite does not provide legal advice, representation, or regulatory certification. The Services are advisory in nature and offered as non-legal compliance risk assessments based on publicly available guidance from the U.S. Food and Drug Administration (FDA), Federal Trade Commission (FTC), and related authorities.

2. No Legal or Regulatory Warranty

The content provided through the Site and Services is for informational purposes only and does not constitute legal advice. You acknowledge and agree that no attorney-client relationship is created by your use of the Site or engagement of our Services.

We do not guarantee approval, acceptance, or non-enforcement by the FDA, FTC, Amazon, Meta, or any other regulatory or commercial platform. Compliance decisions and liability remain solely with you. Our risk assessments do not substitute for a legal review and are not intended to preempt regulatory scrutiny or enforcement.

3. Client Obligations

You represent and warrant that all materials you submit to ClaimKite for review are complete, accurate, and current. You agree not to submit content that violates applicable law, misrepresents product attributes, or is otherwise deceptive or misleading.

You are responsible for implementing any revisions based on our findings. If you revise claims, labels, or marketing language after receiving your audit, the findings of that audit are no longer applicable and ClaimKite assumes no liability for subsequent uses.

4. Fees and Payment Terms

All pricing is fixed as published on our Site and is due in full at the time of purchase. Payments are processed via Stripe or any third-party payment processor designated by ClaimKite. All sales are final and non-refundable, in any circumstance.

Recurring subscriptions are billed on a monthly basis. You may cancel at any time prior to your next billing cycle; no partial refunds will be issued for early cancellation.

5. Intellectual Property

All content on the Site, including without limitation all text, graphics, reports, audits, layouts, blog posts, training materials, and proprietary frameworks, are the intellectual property of ClaimKite and are protected by U.S. and international copyright, trademark, and other applicable laws.

You may not reproduce, distribute, modify, reverse-engineer, republish, or commercially exploit any portion of the Site or Services, including deliverables provided to you, without express prior written consent from ClaimKite.

ClaimKite reserves all rights not expressly granted herein.

6. Confidentiality

ClaimKite agrees to maintain the confidentiality of client-submitted materials, except where disclosure is required by law or agreed in writing. All materials submitted for review will be handled in accordance with industry-standard data security practices, including secure storage (e.g., Box.com) and restricted access.

By using the Site or Services, you agree not to use, harvest, scrape, or attempt to extract proprietary insights, processes, or risk frameworks embedded in our deliverables, blog content, or public-facing communications.

7. Use of Website and Public Content

You agree not to use the Site for any unlawful purpose or in any way that could harm ClaimKite or others. You may not use data, strategies, regulatory commentary, or examples shared via blog posts, public pages, or FAQs to build competing tools or services or for unauthorized commercial use.

All such content is for educational and informational purposes only and is owned by ClaimKite. No license or right to use any content is granted by implication or otherwise unless expressly authorized.

8. Disclaimers and Limitation of Liability

9. Termination

Upon termination, you must cease all use of the Site and Services, and any outstanding payment obligations remain due.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in the state of Wyoming, and you hereby consent to the personal jurisdiction of such courts.

11. Modifications

ClaimKite reserves the right to modify or update these Terms at any time. Any such changes will be posted on this page with an updated effective date. Your continued use of the Site or Services constitutes your acceptance of the modified Terms.
